Terms & Conditions

These terms and conditions form an agreement between you and the Heart of Yoga Foundation of 503 Playa, Newport Beach, California 92660, United States. This corporation is a nonprofit nonstock corporation organized under the General Corporation Law of the State of Delaware ("DGCL") and is not authorized to issue any capital stock. The specific and primary purpose of this corporation is to engage in charitable and educational activities within the meaning of Section 501(c)(3) of the Internal Revenue Code of 1986, as amended (the "Code").

Definitions

The Heart of Yoga Foundation: Is a legal non-profit organisation registered in the United States as the Heart of Yoga Foundation.

Online Studio: Is a secure web based platform providing registered members with access to online courses, scheduled classes, events, workshops and other resources.

Free Member: Someone who is a member of the Online Studio for no cost, with access to the Online Studio's resources as allocated to "Free Members".

Supporting Member: Someone who is a member of the Online Studio and is paying a monthly contribution of an amount of their choice with access to the Online Studio's resources as allocated to "Supporting Members" in addition to the resources available to "Free Members".

Payment Terms, Cancellations and Refund Policies

Supporting Member Monthly Contribution

Monthly contributions that you have created will not automatically cancel. If you would like to cancel a monthly contribution (or change to the free membership), you may do so at any time within your Online Studio membership area. In order to not get billed for the following month, you will need to cancel at least 48 hours before the renewal date stated within your membership area.

If you change the amount of your supporting membership, this new amount will apply from the next renewal payment date (shown in your profile membership area). Again, you will need to change this at least 48 hours before the renewal date.

Once cancelled or switched to a free membership, you will no longer be charged going forward. You will retain access for the remainder of that month, until the date indicated on which your membership would have renewed. Payments not cancelled in time before the next billing cycle will not be refunded, so make sure to cancel prior to the indicated day if that’s what you want to do.

Partial month or partial refunds are not possible. We cannot refund past months for a reason of non-participation or low participation in the Online Studio, or non-observance of the ongoing nature of supporting membership contributions.

If a teacher is unable to teach a class within the Online Studio due to force majeure (event outside their control), a skilled and qualified substitute teacher will take the class. This will be minimised.

In-person and Online Training Events

1. Deposits are not refundable. In the case of an emergency causing a change of plans, deposits can be put towards a later training elsewhere or towards an online training. If for any reason your application cannot be accepted, such as the retreat being booked out before we receive your application, you can choose to be refunded straight away, or remain on a waiting list and be refunded closer to the time of the training if no spaces become available.

2. Payments for the rest of the training are not refundable within 30 days of the start day of the training, however they can be transferred to future events or toward online education. Heart of Yoga Foundation is not obligated to refund collected payments within 30 days of the training start date. Prior to 30 days, payments can be refunded if necessary, excluding the deposit.

3. If the unlikely event we are forced to cancel the training prior to it beginning, everyone will receive their money including deposit refunded.

4. If for any reason the training is disrupted while underway by an extreme event (disaster, volcano, pandemic etc) then we will continue when possible and shift online when not. In such a case, meals would be refunded but accommodation cannot be.

Online Courses

Online courses can be accessed via the Online Studio dashboard. If you sign up for one of the courses and really feel it is not for you, we can refund you on request. It may take up to a week to process a refund, this is due to the payment processor and not in our control. If you are just having trouble accessing the course or cannot download any aspects, please contact studio@heartofyoga.com for help.

Some courses have the option to be paid by installments. The first installment will be charged to the card details you provide when you sign up, after which you will have full access to the course. The remaining installments will be automatically charged to the same card on or near the same day each month for the remaining number of installments. If an installment payment is not able to be processed for any reason (e.g. low balance, declined card), access to the course will be suspended until you update your card details.

One-off Online Workshops

Refunds for emergencies etc are available up to 48 hours beforehand, no refunds after this.

Overall

We cannot guarantee any particular results or experiences as it all depends on your approach to your sadhana, to learning, to practice. However your ideas, feedback and experiences are always welcomed sincerely. Please contact studio@heartofyoga.com.

Zoom Gatherings / Class Mood

By accepting these terms and conditions, you agree to behave in a friendly or neutral way to other participants in Zoom gatherings, with no hostility, ad hominem attacks, passive aggressive ‘correction’ of others, slurs, bigotry or abuse. We all agree to try to abide by the principle of "when do you teach – when you are asked to teach" and come in a mood of openness and willingness to learn.

You agree to Zoom classes being recorded and made available for other Online Studio members to watch later. The recorded session will not be made available to the general public.

Liability

You agree on behalf of yourself (and all your personal representatives, heirs, executors, administrators, agents, and assigns) to release and discharge Heart of Yoga Foundation (and affiliates, related entities, employees, agents, representatives, successors, and assigns) from any and all claims or causes of action (known or unknown) arising out of danger, risk or negligence, whether active or passive, or any of this trainings teachers, guests, other students, affiliates, employees, agents, representatives, successors, and assigns. This waiver and release of liability includes, without limitation, injuries which may occur as a result of (a) your use of any equipment or facilities which may malfunction or break, (b) improper maintenance of any equipment, premises or facilities, (c) negligent instruction or supervision including (d) services performed by employees (e) slipping or tripping and falling while on any portion of a premises or while traveling to or from training events, including injuries resulting from activities performed on or off premises.

I (the student agreeing to these terms and conditions) understand that Yoga practice, learning and life can bring up all kinds of feelings and sensations, including mental, physical, emotional and spiritual challenges, and I personally assume the responsibility for any risk in these areas and do not hold the Heart of Yoga Foundation responsible or liable for any physical, spiritual, or mental risk or injury while attending classes or using the Online Studio. I understand that in an online learning situation, a teacher cannot physically prevent me from injuring myself from pushing too hard or ignoring my limits, or accident through misfortune, or lack of sensitivity to my own limits, and I agree to take responsibility for my own physical and emotional-mental safety and not hold any teachers liable for any injuries that occur during or as a result of Online Studio classes or activities. I hereby release the Heart of Yoga Foundation and all teachers, directors, volunteers, employees and agents therein from any and all liability and agree that I and any representatives will not sue or defame anyone abovementioned for any liability encountered while participating in the Online Studio.

I agree to indemnify, hold harmless and agree not to sue any of the above entities and that at no time in the future will I or any of my relations, spouses, descendants or representatives bring any legal action against the Heart of Yoga Foundation.

I agree that if I feel upset or challenged by any teachings presented in the Online Studio, to reflect on these to the best of my ability before reacting or casting aspersions. I acknowledge that the process of spiritual growth and Yogic understanding can involve emotional upheaval and I agree to not project any of my own process onto others to the best of my ability. I agree to seek resolution through conversation and discussion as the first step if I feel upset by something.

I understand that the Heart of Yoga Foundation is not a medical establishment and the teachers are not doctors or physios; that physical healing is not advertised, guaranteed or promised; and that I am responsible for my own bodily health and healing with the health professionals of my choice.

I acknowledge that I am healthy and able to participate in classes, and mentally and emotionally capable of attending and participating in yoga classes and discussions, which may include discussion of all kinds of topics including death, sex and relationships. I do not have to participate if I do not wish to and I take responsibility for my own level of participation.

I agree that if I experience any adverse effects from asana/pranayama practice such as dizziness, nausea, feeling unwell or any other symptoms, and are feeling worried, I will take the responsibility to check on these with a health professional for (for example) low blood pressure.

I understand that there may be discussions on conventionally taboo topics such as sexuality that may cause me feelings of embarrassment or discomfort, and I agree to take responsibility for my own feelings and reactions to socially loaded subject matter. I understand there is never any pressure to listen to or speak on subjects that make me uncomfortable. We encourage people to sit with this discomfort as it can be a positive sign of expansion and release. Discussions of sensitive subjects will always be private, respectful, optional, and for the sake of everyone experiencing freedom and ease in respectful relationships.

I understand that there may be those present with different opinions and experiences to me and I agree to actively exercise tolerance, understanding, compassion, love and grace to the best of my ability. I agree to not try and be right about everything all the time or try to convince others of my “point of view” unasked.

I hereby certify that I have read these terms and conditions and understand and agree to them all. I attest that I am an adult human being, over 16 years of age, and able to make decisions regarding my own learning, body and wellbeing, and choose what to participate in or not. I consent to these cancellation and refund terms and to this release of liability.
